Reimbursement Alimony
Reimbursement spousal support may be awarded when one spouse has made financial or non-financial contributions to the financial resources of the other during the marriage. An example would be where one spouse paid for the other to attend medical school. The contributions may also be indirect, for example, if one spouse paid the household expenses while the other completed his or her studies. Reimbursement alimony allows the spouse who made these contributions to recover at least some of the amount given. It may be made in a lump sum payment or in installments and may not be
modified after a judgment is issued.
While a spouse's need and the other's ability to pay is often the major factor in determining whether to award spousal support, these do not have the same sway in cases of reimbursement. Reimbursement alimony may not, however, be available for marriages over 5 years in length.
