It defines each person's assets and liabilities, their authority over each other's property, how their earnings and savings will be used, and how their property would be divided in the case of a divorce. It also describes how alimony will be paid.
Many of today's couples are choosing to address these matters with a prenuptial agreement. In a recent survey, 73 percent of attorneys cited a substantial increase in prenuptial agreements in the past 5 years. They have become much more common, especially with people who are earning large amounts of money, own multiple properties, have been married before, or have children from a previous marriage.
It is an interesting fact that 53 percent of the attorneys surveyed said that more women are requesting these prenuptial agreements. They are bringing assets into the marriage now, and wish to protect themselves.
