Understanding The Divorce Process
It’s natural to be afraid of the divorce process. Each of you has had a friend who has gone through it and tells a tale of horror that you find unimaginable. You were the friend who “was there for them,” and now it’s your turn to go through this God-awful thing called "divorce" yourself.
Let me see if I can’t make it a bit easier for you with these simple 5 steps:
- Take a Deep Breath. You’ve been through tough times before and they define you. Without meaning to be too dramatic, all good things come from tough times. As a country, just as we survived the 9/11 attacks which rejuvenated the American spirit. In my opinion, the great recession of the early 21st century will rejuvenate the American work ethic. With the right divorce attorney giving you guidance, you will survive your divorce also and you will thrive in future years.
- Hire An Attorney. Going through the divorce process is not like building a deck. Just because you know which steps to take, doesn’t mean you can climb them easily or that your time isn’t better spent on your own work or doing something less stressful and draining.
-
Understand the Process.
Take the time to understand the process with your divorce attorney. Every divorce starts with a Complaint or a Petition and if the case doesn’t settle, is followed by a period of discovery, a Pre-trial Conference and a trial. The majority of cases never make it to trial as settlement is always preferable to a judge deciding your case.
-
Always Be Willing To Listen. Whether it’s to your attorney guiding you through the myriad of issues that arise which relate to custody, child support,
visitation , listen to your attorney and be willing always to listen to settlement offers.
5. Always Put Your Children’s Interest Ahead of Your Own. No exceptions. If both parties put their monetary issues and the distribution of assets aside and make the difficult child-related issues with the best interest of their children in mind, your divorce will no doubt go smoother and faster and your children will be much better off.
