Common Problems During Visitation
Joint legal custody means both parents have equal authority to make major decisions concerning the child.
Sole legal custody means one parent makes all the important decisions regarding the child. Judges do not base custody solely on a child's preference, more attention is paid when they are teenagers but the final decision is made by the court in accordance with the best interest of the children.
Child support follows custody. Once a child reaches the age of eighteen they reach
emancipation, however in the case of a full time student the court may order support up to the age of twenty-three.
Visitation or parenting time is derivative of custody. In cases where a spouse is not paying child support or a spouse does not allow the other visitation rights the only suitable reaction is to file a
contempt action to enforce the appropriate law.
Things can become uncomfortable when a spouse has a new significant other in their life and they are around your children, courts will sometimes restrict the presence of this person until a divorce is final and after a period of adjustment the restriction will be lifted.
Remember always, visitation is a time to be spent and treasured with your childrenand not with your boyfriend, girlfriend or significant other.
