When You Can Take Advantage of MA Alimony Reform

The recent alimony modification in Massachusetts has sparked alot of excitement among both people filing for divorce and current divorcees alike. The new law limits alimony payments according to length of marriage, ends payments upon remarriage of the recipient of alimony, as well as suspending, reducing, or even terminating alimony upon cohabitation of the recipient with a new mate for 3 months or more.

Many couples are anxious to take advantage of these progressive new terms. The new law is effective for alimony judgements submitted on or after March 1, 2012. Those couples who want to file for an alimony modification based on the new legislation must wait until:

  • March 1, 2013 for those married less than 5 years, or any payor who will reach federal retirement age before March 1, 2015.
  • March 1, 2014 for those married 5-10 years.
  • March 1, 2015 for those married 10-15 years.
  • September 1, 2015 for those married 15-20 years
