Alimony Reform Bill Passed
The much publicized Alimony Reform Act of 2011 was recently passed by Massachusetts legislation. Moving forward this will greatly effect the handling of alimony in your
divorce. The following are the top five reasons why the Alimony Reform Act will change your alimony settlement for the better.
1. The alimony term will be limited in relation to the length of time the marriage lasted.
2. Alimony should not go beyond the recipient's need "or 30 percent to 35 percent of the difference between the parties gross incomes" decided upon when the order was issued.
3. The alimony recipient's alimony is terminated if they so decide to get remarried.
4. Upon remarriage of the payer, assets and income of the new partner are to be excluded from any redetermining of the alimony settlement.
5. The extending of an alimony term is limited and requires "clear and convincing evidence."
