Massachusetts Family Lawyer

Providing Help for Past-Due Support Payments

According to the Commonwealth's Department of Revenue every month thousands of parents are in violation of courts orders by not providing the financial support that they are required to make by the law and by their duty as parents. Sometimes this is due to financial circumstances, such as a job loss, but often it is also due to a decision on their part to withhold support in an effort to control or manipulate a situation. Whatever the reasons, the government and enforcement agencies do not take lightly to the non-payment of child support. The children are the ones who suffer and for this reason there are many avenues of pressure that the law can exert to assist in a collection action. A Massachusetts family law attorney can assist you in understanding not only your rights but also the enforcement actions available to you.

The Provisions for the Collection of Past-Due Support

The law has provided powerful remedies to assist you in the collection of past-due or insufficient support. Many custodial parents are unaware of these actions that can be taken or are so overwhelmed by the situation that they are not able to cope. The following are some of the actions that a family lawyer can assist you with:

  • A notice can be sent by the DOR informing of the past due amount PLUS interest
  • An income withholding order (IWO) can be obtained and issued
  • In the case of past due support, delinquent support or insufficient support this IWO can be supplemented with an increase of up to 25% above the support amount
  • A failure to make support payments can become an automatic judgment and a lien can be placed against all real and personal property
  • A bank levy against accounts can be made for past due support of more than six weeks or $1500
