How do I get custody of my children?
This is one of the most hotly contested areas in many cases of marriage dissolution. State law requires that both parents have access to the children (except in cases in which one parent has been proven to be a danger to their wellbeing – in which case there may be supervision required). Addressing this matter carefully is important as the decision of the court will be based upon the best interest of the child. Documenting your support for your children, both emotional and financial is part of what must be brought to court. Some cases will require witnesses or child experts to support the case. We are prepared to fight for your wishes and seek out the best approach in court if you are seeking custody.
What if I need to change visitation?
When changes are made in court-ordered visitation, it should be done through the courts in a post-judgment modification. We can help you with resolving changes legally and avoiding the problems that can result when court ordered visitation is not complied with.
What if we do not agree on spousal support?
Many former couples have a difficult time with this aspect of marriage dissolution. There is a formula that can determine the amount of spousal support that is due minimally under state law. Even so, there is room for dispute on this subject, and the ability to successfully negotiate this with the opposing attorney can lead to a faster and more successful outcome.
